TERMS & CONDITIONS

These are the terms and conditions pertaining to the Cities of Love Awards, please ensure you read them before applying.

Applicants are required to fulfil the following requisites to participate in the Cities of Love Awards (COLA):

  • Furnish all required information for the entry submissions; and payment of fee
  • Provide documentation and/or any related materials as may be requested by the Judging Committee during any stage of the judging process
  • Arrange for project site access and viewing if requested by the Judging Committee
  • Permit use of images and information and/or provide the same for promotional efforts across all platforms as deemed necessary by the organiser
  • Allow the entry to be exhibited during the stipulated dates as deemed necessary by the organiser

Disclosure of Information

COLA advocates the engagement of the public in a purposeful manner for their understanding of good initiative on sustainability. This involves disseminating relevant information about the entries throughout the entire judging process; as well as featuring the projects on our online database, which will be publicly accessible.

Unless marked with [ND], the organisers will disclose all information provided by the applicants during their online registration. The organisers and Judging Committee are obliged to strictly adhere to the code of confidentiality for non-disclosed information, which will be used in consideration for screening purposes only.

Copyright Information

The copyright for all entries, images and information belong to the respective applicants and may only be used by the organisers for promotional and marketing activities. 

Disclosure of Screening Results

Screening results will be released through our website, along with the Judging Committee’s rationale for awarding the respective entries.

Any requests for the disclosure of individual screening results before the official announcement will be denied.

The organiser may delay the announcement of the results due to unforeseen circumstances.

Protection of Intellectual Property (IP) Rights

a) Usage of Personal and Corporate Information

The utilisation of both private and corporate information provided by the applicant shall be limited to what is necessary to operate COLA’s awarding system.

It is hereby stipulated and agreed upon by and between the organiser and the applicants that this information has received the consent of the applicants for this purpose.

b) Usage of Information of Successful Applications

All applicants reserve the copyrights to the information and related materials provided for the entries submitted, of which usage by the organisers shall be limited to the extent necessary for the screening process and public release.

It is hereby stipulated and agreed upon by and between the organiser and the applicants that this information has received the consent of the applicants for this purpose. 

With regards to entries awarded by COLA, the organiser hereby stipulates permission to the usage of the information provided for publication on the website, the extent necessary for other promotional activities of the Award and to reasonable modifications made under unavoidable instances concerning purpose and formatting. Please refer to the website of the Intellectual Property of Singapore (IPOS) for more information regarding IP rights.

Receiving the Award

All winners are required to attend the awards ceremony. 

Overseas participants who are unable to attend the awards ceremony should nominate someone to receive on their behalf or notify the organiser with 7 days after the announcement of results. 

Postage of trophy and certificates are chargeable to the winners upon request.


DECLARATION OF INTELLECTUAL PROPERTY RIGHTS

Indemnity Clause

Applicants covenants and agrees to hold the founders, organisers, operators, and managers of COLA and the respective officers, agents, and employees of each (hereafter collectively referred to as “COLA Management “) harmless from any and all claims of liability, damage, intellectual property infringement or expense arising from any injury to or death of any person, including the applicant’s employees, agents, or contractors or any loss of, damage to, or theft of any property, including the Applicant’s.

On omission of Applicant shall include any failure of the Applicant to comply with any of the terms and conditions of this Agreement; any rules and regulations of COLA; and any laws of the Republic of Singapore. Applicants agree to indemnify all members of the Award Management Team any and all expenses, attorneys’ fees, and any judgments awarded or settlement amounts agreed to. Applicants also agree that COLA Management is not responsible for any loss, damage, or theft of or to any property of anyone, including the Applicants and its employees, agents or contractors, while in transit to or from the venue space, while in the venue space or otherwise.

The organiser shall bear no liability concerning any disputes and conflict arising between the Applicants and other third parties in connection with application for or receipt of COLA.

Insurance Clause

COLA is not a bailee, insurer, or guarantor of the safety of the Applicant’s property and will not be held liable for loss of or damage to it. All Applicant’s property is understood to be under the Applicant’s custody and control at all times. Applicants must insure their own property.

The Applicants will maintain, at its sole expense, comprehensive general liability insurance covering bodily injury and death to persons and property damage with minimum per occurrence limits of Singapore dollars (SGD) $1,000,000.00 and worker’s compensation and employer’s liability insurance covering all those engaged by the Applicants to provide services on its behalf with minimum limits as required by the laws of the Republic of Singapore in addition to adequate casualty property coverage for its property. The general liability policy will name COLA and the venue owner/manager as additional insureds and all rights of subrogation against the COLA Management must be waived. 

Disqualification, Revocation and Suspension

COLA has the right to disqualify and revoke the Award from an entry under consideration and/or awarded entry should the following occur:

  • The entry is deemed socially detrimental due to its functional defectiveness
  • The entry is publicly recognised as having infringed the intellectual property rights of another party
  • The entry has not adhered to the specifications stipulated in the COLA Usage Guide without the written consent of the organiser
  • Fees for the entry have not been duly paid 

Disqualification and revocation will result in a public renouncement of the entry and its subsequent removal from the website and all future collateral.

COLA Application Withdrawal

Applicants who wish to withdraw their entries may do so before the stipulated submission deadline on 30 June 2021 at 23:59 hours Singapore time (SGT). Withdrawers are required to notify the organiser either via a hardcopy letter or email, along with the reason of withdrawal and entry fee paid is non-refundable.

Please note that after 30 June 2021 23:59 SGT, any requests for withdrawal will not be accepted.

Rights of Usage

Only award winners are eligible to apply for the usage of COLA. All representatives associated with the award winners (i.e. sales and marketing agencies, media partners) and other third parties may only apply to use COLA as the official representatives of the award winners and with their explicit consent. In this instance, the Permission for COLA Usage certificate will be issued directly to the award winners and no further application procedures will be necessary. Consultation with the organiser is advised in cases where:

  • A distributor or sales agent not affiliated with the award winner (or its representatives as described above) wishes to use the COLA logo as part of its sales and marketing campaign.
  • A media organisation not affiliated with the award winner (or its representatives as described above) wishes to use the logo in a description of an award-winning product.

Modifications of Awarded Project

In the instance that modifications have been applied to the project awarded with the COLA, including design specifications and enhancements, the award winner must submit an Alteration Report to the organiser. The organiser and the presiding Judging Committee will then deliberate the extents of the modifications made (i.e. if the changes made conflict with the prior evaluation) and advise the winner of their decision to approve or reject of the continued usage of COLA for that specified project.1
